Epic Games Is Taking Legitimate Steps Against The Fortnite Developer For Stealing The Guise Of ‘The Pumpkin Man’
One question that has ransacked the media lately is that who has stolen the likeness of a character to create a dancing emote on Fortnite as it is rumored that Epic Games Has Filed A Complaint Against ‘The Pumpkin. Currently, this issue is burning the whole gaming industry down.
In October, Geiler famous as the former-viral sensation “Dancing Pumpkin Man” sent the Fortnite developer Epic Games a cease-and-desist letter keeping in focus to remove and abstain from reusing “Pump it Up” emote from the game.
Geiler states that the character whose likeness has been copied is his creation and it is trademarked but Epic Games has used it to grab more eyeballs and to make a profit. On the other hand, Epic Games has refuted all the accusations aimed at them and has filed a formal complaint with a judge claiming that the popular appearance of the “Dancing Pumpkin Man” has not been stolen. So they will stick with using the same emote.
The slide all the accusations into the thin air claiming neither they have named the character from Geiler’s influential creation nor they have used a same-looking jack-o-lantern. It is given a completely different attire with a new look of jack-o-lantern and if Geiler still can find any minute resemblance with his own creation then it might be simply because his character was not that unique.
Epic Games makes research to prove his point that the very attire and pumpkin head made by Geiler is nothing but a very common design that has been used in different movies, games, etc. moreover the game developer makes his stand saying that Geiler didn’t make the leotard or dance to originally composed music. So he can’t claim that character to be trademarked. Even the song he makes the pumpkin head dance is taken from a popular movie Ghostbusters.
After this chaos, Epic games decides to seek legitimate ways to deal with the situation, now all they can do is to wait for the tables to turn in their favor, they hope to hear the decision soon from the judge. It is a unique case that the judge has to deal with for the first time. Now it all depends on the judge’s verdict to this peculiar case where the winner gets to keep his pumpkin man.
